Department attempts to clarify Feb 1, 2021 Executive Directives



An Update from Department on COVID-19
February 1, 2021

Department Guidance for Posts concerning the Executive Directive that went into effect February 1, 2021, and ends February 21, 2021, at 11:59 pm.

NOTES:
1.    The department has attempted to contact the Michigan Health and Human Services Department; however, their voicemail is not taking new messages and they have not returned our emails asking for clarification.

2.   If you are visited by a local, county, or state health official their recommendations, orders, or directives overrule these instructions.

3.   Read the entire order.

The departments' interpretation of the order is:

Looking at Section 3 of the order for entertainment facilities, recreational facilities, and food establishments.

An American Legion Post with a large hall (used for bingo, and "the like"), or who have club liquor license or serve food (Food establishment). Read the order for details.

A food establishment offering indoor dining may not exceed 25% of capacity. (Sec 3, b, 4, A)

NOTE the Post must be closed between 10 pm and 4 am. (Sec 3, b, 4, B)
We interrupt the order to mean that as entertainment and recreational purposes patrons must be 6 feet apart, and not exceed 20 people per 1,000 square feet of space.

All patrons must have a face mask covering their nose and mouth. (Sec. 7, a.)
The Post must maintain a record of at least the name, phone number, and date-time of the patron's visit. This list is to be destroyed 28 days after the day recorded. Section 9.

Can a Post hold an in-person meeting?

We are looking at Section 7 c and d.

c. Except as provided elsewhere in this order, a person responsible for a business, store, office, government office, school, organized event, or other operation, or an agent of such person, must prohibit gatherings of any kind unless the person requires individuals in such gatherings (including employees) to wear a face mask, and denies entry or service to all persons refusing to wear face masks while gathered.

Because the Legion is a business and other facilities opening today with restrictions on, we believe a Post may hold a meeting to conduct business, if they decide. All members wear masks during the meeting, and they are seated 6 feet apart, not to exceed 20 people per 1,000 square feet of space.

As businesses begin to open again, we would recommend that Posts, have their building filtration (HVAC) systems checked and when people are in the building to have the FAN set to ON to consistently move air through the furnace filters.

The most important part is to be safe, wear a mask, social distance, and respect members.
